MA 02649
'4 BOARD OF APPEALS
II
DECISION
FOR A VARIANCE
RE: Mashpee Industrial Park Realty Trust - V-91-51
t A Petition was filed by Mashpee Industrial Park Realty Trust,
Richard P. Crowley TR, for a Variance from Section 174-55.0 and
174-55.I for permission to have two signs on the road layout at
the intersection of Falmouth Road and Industrial Drive in an I-1
zoning district on property located at 5 Industrial Drive
(Map 88, Block 21) Mashpee, MA.
Notice was duly given to abutters in accordance with
Massachusetts General Laws Chapter 40A. Notice was given by
publication in The Enterprise, a newspaper of general circulation
in the Town of Mashpee on August 9, and August 16, 1991, a copy of
which is attached hereto and made a part heAof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, August 28, 1991 at which time the following
members of the Board of Appeals were present and acting throughout:
William J. Hanrahan, Michael A. Makunas and Edward M. Govoni.
Wayne Tavares represented the applicant and reviewed sign
plans which had been approved by the Design Review Committee.
He explained that the heavy traffic conditions on Route 28 made
it difficult to identify the industrial park unless signing
were permitted on each side of the entrance. Signs on either
side of the entrance will be mounted on fencing and a street
identification side will be used in the center section. No
comments were received from abutters.
The Board found that the granting of the Variance would be
in harmony with the general purpose and intent of the by-laws and
would not be a detriment to the surrounding neighborhood. The
Board determined that a literal enforcement of the provisions of the
by-law would result in hardship and congested traffic.
