MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: James and Rosetta Krizansky for a Special Permit SP-91-44 <br /> A Petition was filed by James and Rosetta Krizansky for a <br /> Special Permit under Section 174-17 of the Zoning By-laws for permission <br /> to rebuild and expand a pre-existing non-conforming structure in an <br /> R-3 zoning district on property located at 119 Shore Drive (Map 117, <br /> Block 334) Mashpee_, MA. (Owner of record: Rosetta Krizansky) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 9 and August 16, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, August 28, 1991 at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William J. Hanrahan, Michael A. Makunas and Edward M. Govoni. <br /> Attorney Kevin Kirrane represented the applicants and informed <br /> the Board that the owners wish to replace a seasonal home with a <br /> year-round dwelling and presented plans showing a 20' setback from <br /> Kim Path and 24' from Shore Drive with lot coverage of 19.4%. <br /> The Board determined that a Variance in front setbacks was not <br /> required and that the structure was compatible with other homes <br /> in the area. No comments were received from abutters. <br /> The Board found that the use is in harmony with the purpose and <br /> intent of the zoning by-laws and complies with the provisions therein. <br /> The Board determined that the proposed structure is not substantially <br /> more detrimental to the neighborhood than the existing non-conforming <br /> use. <br />
