BOX 1108 E- OCT 15 int <br /> MBOARD O, AP PEALS <br /> BOARD OF APPEALS / N✓/l{ <br /> Ld1+ j <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of Robert and Natalie Schlundt for a Variance V-91-50 <br /> A Petition was filed by Robert and Natalie Schlundt of Newton, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> for permission to vary the lot coverage requirements in an R-3 zoning <br /> district on property located at 27 Wheelhouse Lane (Map 120, Block 166) <br /> Mashpee, Massachusetts. (Owner of record: Howard Chauncey) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 27 and September 3, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, September 11, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Michael A. Makunas and Cheryl A. Hawver. <br /> Architect Elizabeth Chapman represented the applicant and presented <br /> plans for a proposed pool. She informed the Board that some of the <br /> deck area would be removed and that the topography of the lot <br /> prevented placement in any other location. Evidence was submitted <br /> to the Board on the medical need for the pool. <br /> The Board found that there were circumstances relating to the shape <br /> and topography of the lot in question which did not affect the zoning <br /> district in which the lot is located and that a literal enforcement of <br /> the by-laws would result in hardship. The Board determined that relief <br /> could be granted without derogating from the intent of the By-law or <br /> without detriment to the public good. <br />
