MA 02649
BOARD OF APPEALS
DECISION
FOR A VARIANCE
RE: Edmund F. and Jeannette Daley for a Variance V-91-49
A Petition was filed by Edmund F. and Jeannette Daley of Mashpee,
Massachusetts for a Variance from Section 174-31 of the Zoning By-laws
for permission to vary the setback requirements in an R-5 zoning
district on property located at 108 Pond Circle (Map 64, Block 106)
Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on August 27 and September 3, 1991, a copy of which is attached hereto
and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, September 11, 1991 at which time the following
members of the Board of Appeals were present and acting throughout:
William J. Hanrahan, Cheryl A. Hawver and Edward M. Govoni.
Thomas Brown, Builder, represented the applicant and presented
plans for a 10' x 12' tool shed at the rear of the property. He
explained that the slope of the lot prevented any other location.
No comments were received from abutters.
The Board found that the topography of the lot created a
hardship affecting the land in question but not affecting the
zoning district in which the land is located and that relief
may be granted without nullifying the intent of the By-laws or
without detriment to the public good.
