MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Edmund F. and Jeannette Daley for a Variance V-91-49 <br /> A Petition was filed by Edmund F. and Jeannette Daley of Mashpee, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> for permission to vary the setback requirements in an R-5 zoning <br /> district on property located at 108 Pond Circle (Map 64, Block 106) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on August 27 and September 3, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, September 11, 1991 at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William J. Hanrahan, Cheryl A. Hawver and Edward M. Govoni. <br /> Thomas Brown, Builder, represented the applicant and presented <br /> plans for a 10' x 12' tool shed at the rear of the property. He <br /> explained that the slope of the lot prevented any other location. <br /> No comments were received from abutters. <br /> The Board found that the topography of the lot created a <br /> hardship affecting the land in question but not affecting the <br /> zoning district in which the land is located and that relief <br /> may be granted without nullifying the intent of the By-laws or <br /> without detriment to the public good. <br />
