MA 02649 NOV 29 n9 <br /> JL <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> Re: Vickie J. Neal for a Special Permit SP-91-66 <br /> A.-Petition was filed by Vickie J. Neal of Mashpee, Massachusetts <br /> for a Special Permit under Section 174-17 of the Zoning By-laws for <br /> permission to operate 'a gift shop in an R-5 zoning district on property <br /> located at 100 Great Neck Road North (Map 45, Block 3) Mashpee, MA. <br /> (Owner of record: Richard E. Halpern TR) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 25 and November 1, 1991, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, November 13, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, Edward M. Govoni and John J. Friel. <br /> Vickie J. Neal represented the Petition and explained that she <br /> would be selling hand-crafted gift items in space formerly used as <br /> a real estate office. <br /> The Board found that the extension or change would not be more <br /> detrimental to the neighborhood than the existing non-conforming use. <br /> The Board also established that the granting of the Special Permit <br /> would not be detrimental to the Town and would be in harmony with the <br /> general purpose and intent of the By-laws. <br /> III{ <br /> I <br />
