MA 02649 <br /> BOARD OF APPEALS <br /> e� <br /> DECISION <br /> FOR A VARIANCE <br /> Re: Friends of the Mashpee Council on Aging for a Variance V-91-61 <br /> A Petition was filed by the Friends of the Mashpee Council on <br /> Aging for a Variance from ,Section 174-39 of the Zoning By-laws for <br /> permission to vary the number of parking spaces in the renovation <br /> and addition to the Mashpee Senior Center on property located in <br /> an R-5 zoning district at 500 Great Neck Road North (Map 67, Block 11) <br /> Mashpee, MA. (Owner of record: Town of Mashpee.) <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 25 and November 1, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, November 13, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, Edward M. Govoni and John J. Friel. <br /> Charles Buckingham of the Senior Center Addition Building Committee, <br /> presented plans for the addition to the Center and explained that the <br /> total parking would exceed the present number of spaces. He asked <br /> the Board to approve a total of 47 spaces and explained that the Center <br /> would seldom be used to maximum capacity. <br /> The Board found that relief could be granted without nullifying or <br /> derogating from the intent or purpose of the zoning by-laws or without <br /> detriment to the public good and that there were circumstances relating <br /> to the topography of the lot which created a hardship affecting the land <br /> in question but not the zoning district in which the land is located. <br /> i <br /> i <br />
