MA 02649
BOARD OF APPEALS
DECISION
FOR A SPECIAL PERMIT
RE: Guy and Marie D'Aleo for a Special Permit SP-91-63
A Petition was filed by Guy and Marie D'Aleo of Mashpee,
Massachusetts for a Special Permit under Section 174.25.A.8 of the
Zoning By-laws for permission to construct an in-law apartment in
an R-3 zoning district on property located at 15 Aries Lane (Map 93, .
Block 30) Mashpee, MA. (Owner of record: Vincent S. Porciello TR) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee'
on November 8 and 15, 1991, a copy of which is attached hereto and
made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, November 27, 1991 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: Michael A. Makunas, John J. Friel and Edward M. Govoni.
Builder Vincent Porciello and Mr. D'Aleo represented the Petition.
They presented plans for the conversion of a single-family house design
to accomodate a mother-in-law suite. An abutter present spoke in
favor of the Petition.
The Board found that the plans met the criteria of the Zoning
By-law providing no external evidence of occupancy by more than one
family and that each dwelling unit would not have less than 750
square feet. The Board determined that the use is in harmony with
the general purpose and intent of the zoning by-laws and complies
with the provisions therein.
i
