Salvo for a Variance - V-91-72 <br /> A Petition was filed by Joseph C. Salvo of Waltham, Massachusetts <br /> for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the rear setback requirements in an R-3 zoning district on <br /> property located at 20 Whippoorwill Circle (Map 125, Block 170) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee; <br /> on November 22 and November 29, 1991, a copy of which.is attached <br /> hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, December 11, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Michael A. Makunas and Cheryl A. Hawver. <br /> Mr. Salvo represented the Petition and informed the Board that <br /> the unusual shape of his lot and the location in two flood zones had <br /> required that the house be constructed as far back on the lot as <br /> possible. A deck was constructed at the rear of the property three <br /> feet from the lot line. Written comments were received from abutters <br /> in favor of the Petition. <br /> The Board found that .the shape of the lot created a hardship <br /> affecting the land in question but not the zoning district in which <br /> it is located and that relief could be granted without derogating <br /> from the intent of the by-law or without detriment to the public good. <br />
