By
vote made on April 13, 2022, and filed with the Mashpee Town Clerk on April 26,2022
("Decision"), the Board denied BEC's application for a Special Permit to raze and replace a
single-family home located at 42 Spoondrift Way, Mashpee, Barnstable County, Massachusetts
("Subject Property"). BEC contends that the Board's decision is improper as, inter alia, BEC
demonstrated its entitlement to a Special Permit pursuant to Mashpee Zoning By-Laws("Zoning
By-Laws") § 174-17.1. The Board's Decision exceeded its authority and/or was arbitrary and
capricious and should be annulled. a wm,
i 11'
¢ 1 ' 13
f
