Phillips Doc.: 1324804 <br /> 4 Blair Circle Ct£: 213401 <br /> (Map 3 Parcel 40) <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 22, 2022 by Petitioner, Keith Gilmore, requesting a <br /> Variance of the front yard setback under §174-31 (Land Space Requirements) of the <br /> Zoning Bylaws to allow for an addition on property located in an R-5 Zoning District, at 4 <br /> Blair Circle, Map 3 Parcel 40, Mashpee,MA. (Owner of Record: Daniel E. Phillips). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on March 11, 2022 and March 18, 2022 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,March <br /> 23, 2022 at which time the following members of the Board of Appeals were present and <br /> acting throughout;Chairman,Jonathan Furbush,Vice Chairman, William Blaisdell, Board <br /> Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> Keith Gilmore represented the Variance request for the homeowner. The project consists <br /> of an addition on the front right side of the home facing Blair Circle. The site plan depicts <br /> a pre-existing non-conforming dwelling and sits on al5, 019 sq. ft. lot. The right front side <br /> shows an existing dimension of 40.5 ft. from the front, and 25 ft. for the new addition <br /> creating a new non-conformity, but is within the setbacks under the bylaw. The house is <br /> non-conforming because it has two fronts, and is located on a cul-de-sac with a three <br /> bedroom septic system. There are currently two bedrooms on the second floor, and the <br /> owner would like to have another bedroom, and a family room. <br /> Chairman Furbush asked where the driveway is located because it was not depicted on the <br /> site plan. Keith said that the driveway is a half-circle in the front facing Blair Circle and <br /> exits onto the Deerfield Rd. side of the property. The project needs to meet the required <br /> parking under the bylaw. <br /> 1 <br />
