10% of all permanent housing will be affordable to low-income households. The HPP <br /> must be consistent with the housing policy of the town as stated in the town's <br /> Comprehensive Plan. The state requires the HPP to be revised every 5 years and <br /> submitted to DHCD for their approval. In Mashpee the Committee has been tasked with <br /> drafting the HPP for Planning Board and Select Board approval, which is in turn <br /> submitted to DHCD for its approval. <br /> With DHCD approval and an annual affordable housing production record that meets the <br /> goals expressed in the HPP, the town zoning bylaw is protected from appeal to the State <br /> Housing Appeal Board. If a town fails to meet its HPP production goal, a developer <br /> denied a comprehensive permit by the Zoning Board of Appeal can appeal to the state <br /> Housing Appeal Committee (HAC)to override the local ZBA denial and grant a permit for <br /> the project. Since 1976, when 40B provisions were passed, the HAC has typically sided <br /> with developers over municipalities that have denied a 40B Comprehensive Permit and <br /> have not yet reach their 10% affordable housing goal. <br /> The Chairman continued with a description of the current HPP in Mashpee. In 2015 <br /> Mashpee submitted a locally approved HPP document to DHCD which was <br /> subsequently approved. It called for producing 32 units per year over a ten year period <br /> to enable the town to meet its 10% goal. Since the 2015 HPP was approved, Mashpee <br /> has not met the 32 unit goal in any year and in 2020 the DHCD approval expired. To <br /> update the HPP the Planning Board has made available funds for retaining consultant <br /> help. <br /> e. Mashpee Housinq Partnership (MHP). <br /> This Committee also serves to perform the functions and duties of the towns housing <br /> partnership. Habitat for Humanity homebuyer projects go to the MHP for approval. <br /> Under Mashpee Bylaws, the Affordable Housing Committee serves as the local housing <br /> partnership. To date Habitat has built 21 single family homes since 1991. The <br /> agreement restricting the transfer of land to low income households did not cover the <br /> first couple homes. When the mortgage was paid off the restriction disappeared. A <br /> typical Habitat home can be built on a nonconforming lot totaling less than an acre of <br /> land, or Habitat can take one acre and build two homes, like what has been produced at <br /> Mendes Way. <br /> f. Affordable Housing in Mashpee and on Cape Cod. <br /> There are 343 units on the DHCD Subsidized Housing Inventory (SHI) in Mashpee. The <br /> Chair obtained the list from the DHCD law department files, but it is the town's obligation <br /> to notify DHCD whenever there are additions or corrections to the list. <br /> Chairman Isbitz ranked all 15 towns in Barnstable County based on number of <br /> affordable units that are on the SHI in each town. They are ranked by percentages in <br /> each town from high to low. He compiled the second list by actual number of SHI units <br /> in each town. As of December 2020, Provincetown is at 9.7%, Orleans is at 9%, on the <br /> high side. On the low side, Truro is 2%. Mashpee ranks 8th at 5.3%. By number of <br /> units, Mashpee ranks 6th. Relative to other towns, Mashpee is not faring poorly. <br /> However, the actual need is far greater than 10%. The actual need is almost 1,000 units. <br /> 4 <br />
