;moo Town of Mashpee <br /> 16 Great Neck Road North <br /> / P M Mashpee, MA 02649 <br /> t M <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 8,2022 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, June 8, 2022, at <br /> 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road North. <br /> Chairman, Jonathan D. Furbush, Board Members William A. Blaisdell, Ron Bonvie, Norman J. <br /> Gould,Associate Members Sharon Sangeleer,Charlie Reidy,Brad Pittsley, and Robert Caggiano <br /> were present. Building Commissioner, David Morris was also present. <br /> Chairman Furbush opened the meeting at 6:00 pm and announced that the hearings were being <br /> televised live on Mashpee TV. He will take continents after each hearing. <br /> NEW HEARINGS <br /> 51 Timberlane Drive: Owner, Mashpee Tree House, LLC requests a Written Finding under <br /> §174-17 of the Zoning Bylaws to allow for an addition, extension of a pre-existing, non- <br /> conforming single-family dwelling on property located in an R-5 Zoning District, Map 29 <br /> Parcel 33B, Mashpee, MA. <br /> Attorney Brian Wall represented the applicants for their request to add a 14 ft. by 26 ft. <br /> bedroom addition on the south side of their existing dwelling. A finding is required because <br /> the lot and dwelling are non-conforming, and the proposed addition does not comply with <br /> current dimensional requirements under Section 174-31, and specifically to wetlands under <br /> Section 174-33. <br /> The site plan provided depicts the existing dwelling setback 40 ft. The side yard setbacks are <br /> 4.3 ft. on the north and 17.5 ft. on the south. The rear property line backs up to Santuit Pond, <br /> and the house is 43 ft. from the edge of the pond. The existing lot coverage is 16.2%. The lot <br /> is undersized at 12,468 sq. ft. when 80,000 sq. ft. is required. The side yard setback on the <br /> north is 4.3 ft. where 15 ft. is required. The house is setback 43 ft. from the pond, and 50 ft. is <br /> required. The addition complies with the front and side yard setbacks. <br /> Mr. Wall referred to footnote 19 in Section 174-31 which provides that the setback <br /> requirements to a house does not apply to an overhang that is not more than two (2) feet. The <br /> distance to the front facing wall of the house is 39.2 ft. and the foundation is setback 40.7 ft. <br /> The addition is within the 50 ft. setback to wetlands, but is not getting any closer than what <br /> currently exists. <br /> 1 <br />
