�y <br /> r2 <br /> MASHPEE PLANNING BOARD MEETING MINUTES <br /> MAY 1, 1991 <br /> MEETING COMMENCED AT 6:3 0 P.M. <br /> Members Present: Tony Ferragamo, Judy Mills , Louise Behrman, Pat <br /> Coffey <br /> Also Present: Tom Fudala, Town Planner, Charles Rowley, <br /> Consulting Engineer <br /> DISCUSSION <br /> Applicant: Patrick Butler <br /> Location: Windchime Point Condos <br /> Request. Report on status of negotiations with Trustees of <br /> Reservations and Windchime condo owners . <br /> Pat Coffey stepped down. <br /> Attorney Pat Butler was present representing the applicant. <br /> He stated that there were 3 issues outstanding at the previous <br /> meeting: <br /> A. A site visit by a representative of the Trustees of <br /> Reservations. Mr. Butler stated that this did occur, Mr. Wyman <br /> visited the site. <br /> They have raised an issue which needs input from the Board be f ore <br /> they can proceed. They had originally had a conservation <br /> restriction format which ran to the Town of Mashpee and the Board <br /> was concern Trustees were not involved to extent originally <br /> intended. They do want to be involved, with the Conservation <br /> restriction running to them and they do want to have enforcement <br /> but feel it should be a joint restriction with the Conservation. <br /> Commission and Board of Selectmen who will also have rights of <br /> enforcement. They propose to divide the responsibility area. He <br /> presented a plan with the two areas highlighted. The client has <br /> no problem with it. Mr. Butler is in the process of re-drafting <br /> a conservation restriction. There will. be a. definition of "Zane <br /> A and Zone B" to differentiate to two areas . The Trustees only <br /> want to deal with the major open space. <br /> Mr. Butler asked the Board's permission to begin the re-draft of <br /> restrictions . <br /> Judy asked if the Town was loosing its authority to enforce in <br /> those areas? <br /> Mr. Butler stated that they were not, Cons Com would have <br /> authority for enforcement. The Planning Board always has the <br /> right under the special permit; this is in addition to the <br /> Special Permit. <br /> Louise stated that if they are involving the Conservation <br /> Commission specifically they should be notified and consulted. <br /> It was the consensus of the Board that this proposal is <br /> appropriate as long as it is reviewed by the Conservation <br /> Commission. <br /> 1 <br /> mf. <br />
