PROCEDURAL PROVISIONS <br /> 6. Provisions,Relating,to Sections 64 and 65 of Chapter 5.9. For FY2023-FY2027, <br /> the Taxpayer shall file no abatement applications under G.L. c. 59, §§64 and/or 65 ("Section 64 <br /> or 65 Abatement Applications"), or any other proceedings in any venue,including without <br /> limitation claims alleging overvaluation, disproportionate assessment,improper classification or <br /> any constitutionally impermissible taxation of the Taxpayer's Centrally Reported Property <br /> situated in Mashpee. However,nothing in this paragraph 6 or this Agreement shall prevent the <br /> Taxpayer from filing and pursuing the following sorts of Section 64 or 65 Abatement <br /> Applications: (a) Section 64 or 65 Abatement Applications seeking an abatement with respect to <br /> any Mashpee assessment of the Taxpayer's real property; (b) Section 64 or 65 Abatement <br /> Applications seeking an abatement of any assessment made against the Taxpayer's personal <br /> property(if any)that is valued and assessed by Mashpee;and(c) Section 64 or 65 Abatement <br /> Applications challenging any failure of Mashpee to assess the Taxpayer's Centrally Reported <br /> Property based upon the Commissioner's Mashpee Central Valuation. Further,nothing in this <br /> paragraph no. 6 shall prevent the Taxpayer from commencing or pursuing an action as permitted <br /> in paragraph nos. 5 or 13 of this Agreement. <br /> 7. Disclosure of State Tax Forms 5941. Provided that Mashpee has first entered into <br /> this Agreement,Mashpee may, for any of FY2023-FY2027,make a written request via e-mail <br /> transmission(the"Request")to the Commissioner to receive the following documents and <br /> information(the"Materials") for any such fiscal years: (i) a copy of the Taxpayer's Form 5941 <br /> and appendices, exclusive of the listing of the Centrally Reported Property; (ii)the listing of the <br /> Centrally Reported Property situated in Mashpee(the"Property Listing"); and(iii)the <br /> Commissioner's valuation worksheet for the Mashpee Central Valuation.
