that he wanted the note about the garbage disposal to be revised to say "not allowed". Ms.
Willander asked to approve the plan with conditions, and Chair Baumgaertel agreed.
There being no further comments or discussion, Brian Baumgaertel motioned to approve the
septic design plan for 294 Mashpee Neck Road with the following conditions:1)Engineer and land
surveyor stamp be added to plan;2)indications in profile view to show risers, add actual drawings
not just words; 3) language of use of no garbage disposal is allowed rather than none;4) d-box is
moved to a location external to SAS;and 5)a vent be added, since a portion of system is beneath
the driveway. Motion seconded by Ernest Vigilio. Roll call vote: Brian Baumgaertel (yes); Ernest
Virgilio (yes).VOTE: Unanimous(2-0)
4. Review of Septic Design Plan — 32 Meadow Haven Drive. Chair Baumgaertel commented that
this is continued from last meeting. Chair Baumgaertel noticed deficiencies, such as the locus
map is missing, there is no stamp or benchmark, risers are not indicated in the profile view on
tank or d-box,and revised language relative to the garbage disposal is needed.
There being no further comments or discussion, Ernest Virgilio motioned to continue review of
the septic design plan for 32 Meadow Haven Drive to the next meeting. Review of Septic Failures around Santuit Pond -- At the last meeting, the Board discussed the
status of the failed septic systems around Santuit Pond, and it was decided that Chairman
Baumgaertel would reach out to Chairman Gottlieb to propose a joint meeting with the Select
Board. Since that time, Mr. Gottlieb resigned from the Select Board. This absence on the Select
Board could potentially leave the status of sewers and/or a watershed plan/permit even more
uncertain. I think it is important to mention that failures which have been or are being identified
in areas outside the area that was surveyed around Santuit Pond are not being addressed any
differently than they were prior to the survey. All other property owners with failed septic systems
throughout Town are being notified that they have two years from the date of inspection to
upgrade their systems, per our standard practice. This Board has, in my experience, always put
great emphasis on consistency and past precedent. In this case, the best course of action may be
to notify property owners around Santuit of the two-year timeframe and,if any of those residents
call the office, advise them that the timeframe may be extended if/when a fiscal commitment and
plan are in place to sewer those areas.
There being no further comments or discussion, Brian Baumgaertel motioned to continue the
discussion of the septic failures around Santuit Pond to the next Board of Health meeting. The
motion was seconded by Ernest Virgilio.Roll call vote:Brian Baumgaertel(yes);Ernest Vigilio(yes).
VOTE: Unanimous(2-0).
Ms. Willander commented that the Board has historically endeavored to be consistent and to
follow past precedent; therefore, she wanted to make the Board aware that no other failures in
Town are getting a pass and not being notified/ordered to upgrade their systems within two years.
Chair Baumgaertel agreed with Ms. Willander but does want more information about the sewer
plans in that area. He would like to talk with the Board of Selectmen further. Mr. Virgilio would
also like to see further discussion when we have more information.
6. Update on 88 Lakeside Estates. Ms. Willander reported that, at the last meeting, the Board
discussed the status of the trailer at 88 Lakeside Estates, as it had been a year since the dwelling
had been condemned and the notice to vacate had been posted. The Board subsequently voted
to send the matter to counsel rather than take action to remove or demolish the trailer, due to
