14 <br />Mashpee Select Board <br />Minutes <br />December 5, 2022 <br />WATER QUALITY UPDATES <br />Sandwich 40B Project: (continued) <br />The Town of Mashpee, Sandwich and Barnstable signed an Intermunicipal Agreement (IMA) in <br />November 2017 which identifies the percent of Sandwich's nitrogen input that needs to be removed <br />from the impaired Popponesset watershed. <br />With contaminants of emerging concern, it is important for the applicant to provide an evaluation of <br />standard wastewater treatment versus treatment for contaminants of emerging concern. Recent studies <br />have indicated that typical wastewater treatment does not address contaminants such as <br />PFAS and PFOS which concentrate in the wastewater treatment effluent discharged into the ground. <br />It was agreed that additional information would be provided. It was noted that Joint Base Cape Cod <br />(JBCC) has been testing surrounding watersheds for contaminants, and possibly the pond areas. <br />Chapter 40B is a state law designed to increase housing affordability. Qualifying developers are allowed <br />to bypass local zoning restrictions if at least 25% of the housing units are deed -restricted as affordable. <br />Town's that have met their 10% deed -restricted affordable housing do not quality for Chapter 40B. The <br />Town of Sandwich's affordable housing rate is 4.31%. <br />The developer of the Sandwich project has received approval from Mass Housing to construct 144 units. <br />An additional 240 units are planned at the site location. <br />Based on the groundwater contours there is direct impact to the Town of Mashpee. As the Town moves <br />forward with wastewater and the Watershed Management Plan to maintain compliance with TMDL's <br />there is concern this project would impact Mashpee's watershed. <br />The Town Manager was directed to draft a letter to the Town of Sandwich and to Mass Housing for <br />review at the next Select Board meeting. It is anticipated the Town of Mashpee as concerned stakeholders <br />would re -energize the EVA Agreement between the respective parties. <br />The non-profit, Friends of Peters Pond is holding a meeting to review the Chapter 40B laws in response <br />to the development proposal identified as the Sandwich Green and Village Green. It was disclosed the <br />Town of Sandwich Select Board has not yet received an application from the developer. <br />Comm unit Septic Loan Program: <br />It was recommended the application for the Community Septic Loan program administered by <br />Barnstable County be advertised on the Town's website and social media page to inform residents of <br />this program. <br />
