Devaney <br /> requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for a deck <br /> alteration to a pre-existing non-conforming dwelling on property located in the <br /> Popponesset Overlay District and R-3 Zoning District, 68 Uncle Edwards Road, Map 117 <br /> Parcel 205, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee,on March 25,2022 and April 1, 2022 a copy of which <br /> is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,April <br /> 13, 2022 at which time the following members of the Board of Appeals were present and <br /> acting throughout; Chairman,Jonathan Furbush,Vice Chairman, William Blaisdell,Board <br /> Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> Mr. Richard Devaney represented himself requesting to reconstruct an existing deck that <br /> is in need of repair. He provided a site plan depicting the proposed deck on the Northwest <br /> side of the existing dwelling and will extend 8 ft. toward the back of the lot. The lot size is <br /> 6,500 sq. ft. with the existing lot coverage at 19.1%. <br /> The Board had a conversation and determined that the lot coverage is currently 19.1%,and <br /> the lot size is under 10,000 sq. ft., within the Popponesset Overlay which affords the <br /> applicant to increase the lot coverage up to 25%. The proposed deck will increase the lot <br /> coverage to 21.6%. <br /> Dave Morris explained that the applicant is adding to a non-conforming structure and <br /> therefore requires a Written Finding under Section 174-17. <br /> 1 <br />
