Reilly Doc.: 1349479 <br /> 46 Little Neck Lane Ctf.:_216606 <br /> (Map 105 Parcel 14) <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 17, 2022 by Petitioner, Timothy Luff requests a Variance <br /> under §174-33 (Setbacks from wetlands) of the Zoning Bylaws for a raze and replace of a <br /> single family dwelling on property located within the New Seabury Special Permit Area, <br /> at 46 Little Neck lane, Map 105 Parcel 14, Mashpee, MA. (Owners of Record: Julie Silva <br /> and Martin J. Reilly). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on April 1, 2022 and April 8, 2022 a copy of which is <br /> attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, April <br /> 27, 2022 at which time the following members of the Board of Appeals were present; and <br /> acting throughout Board Members, Ron Bonvie, Norman J. Gould, Associate Members, <br /> Sharon Sangeleer, Charles Reidy, and Brad Pittsley. <br /> Mr. Tim Luff, with Archi-Tech Associates represented the applicants for the Variance <br /> request for setbacks from wetlands. The existing home is located within the New Seabury <br /> Special Permit and does not require zoning for the raze and replace of the home, but does <br /> require a Variance from the wetlands. The existing setback condition from the wetlands is <br /> 15 ft., and the proposed setback will be 18 ft. Mr. Luff met with the Board of Health on the <br /> project that was approved with minor modifications, and was also approved by the <br /> Conservation Commission. The lot is within the New Seabury Special Permit area so there <br /> is no height or lot coverage requirement. The lot coverage will be improving from what <br /> currently exists, and will be at or below the 35 ft. height of the average grade. <br /> GENERAL CRITERIA <br /> The subject property located at 46 Little Neck Lane is approximately 8,600 square feet. <br /> There were no abutters present. <br /> 1 <br />
