MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION OF A <br /> SPECIAL PERMIT AND VARIANCE(SP-2019-53, V-2019-54) <br /> MOD-2022-19 <br /> Attorney Kirrane said he received a letter that was submitted to the Board from Attorney <br /> Wall representing the abutters. The Board supported the raze and replace project despite <br /> any objections by the neighbors. <br /> Attorney Kirrane noted that the Board is well within its authority to issue a modification. <br /> The petition was advertised in the Mashpee local newspaper and mailed to abutters. He <br /> also noted that the septic system allows for four bedrooms,and there is nothing that would <br /> derogate from removing this condition for the purposes of the bylaw, as far as nuisance, <br /> health, safety, and traffic. <br /> Mr. Goldstein read the Board of Health comments into the record that stated, "The room <br /> above the garage was included in the bedroom count when the septic system was recently <br /> upgraded.No action required by the Board of Health." <br /> There were no more comments from the Board. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Modification.Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> May 11, 2022,the Zoning Board of Appeals voted 4 to 1 to issue a modification to Jamie <br /> and Paul Saganey of 28 Jeep Place in reference to an approved Special Permit (SP-2019- <br /> 53) and Variance (V-2019-54) under the Zoning Bylaws to eliminate the prohibition of <br /> finishing the space above the detached garage on property located in the Popponesset <br /> Overlay, and R-3 Zoning District,Map 118 Parcel 108, Mashpee,MA. (Owner of Record: <br /> Paul A. Saganey, Trustee of The Poppy Realty Trust) with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Modification under Mass General Law 40A Section 9. <br /> 2. First & Second Floor Plan: Prepared for Saganey Residence, 28 Jeep Place, <br /> Mashpee, MA.
