Town o,f Mashpee <br /> 16 Great Neck Road.North <br /> �f <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> V-2022-27 <br /> Southworth Mashpee Properties LLC Bk.: 26395 <br /> 130 Willowbend Drive, Mashpee MA 02649 Pg.: 237 <br /> For Property at: 69 Shoestring Bay Road <br /> Map 77 Parcel 137 <br /> Mashpee, MA 02649 <br /> A Petition was filed on June 2, 2022 by Petitioner, Southworth Mashpee Properties LLC <br /> requesting a Variance under §174-33 (Setback from water and wetlands) to allow for <br /> construction of a single-family residential structure on property located in an R-3 Zoning <br /> District, at 69 Shoestring Bay Road, Map 77 Parcel 137, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee, on June 10, 2022 and June 17,2022 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, July 13, <br /> 2022 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, <br /> Ronald Bonvie, Scott Goldstein,and Norman J. Gould. Also present was David Morris,Building <br /> Commissioner. <br /> Attorney,Jack McElhaney represented the Variance petition request for relief from wetlands for <br /> a proposed new home. The home is being built within the 50 ft. setback at the top of the coastal <br /> bank as shown on the site plan that was issued to the Board. The home will be located 17 ft. at <br /> its closest point, with a 3 ft. high retaining wall, and a patio 2.5 ft. from the coastal bank. <br /> The Attorney gave a brief history of the lot that is part of the Shoestring Bay sub-division <br /> originally built in the 1980's. Shoestring Bay Road runs parallel to the bay into the coastal bank <br /> with other homes located on that street. The bank is located roughly 50-150 ft. off the seaward <br /> side of the road.The lots are very narrow, and at the time the road was constructed this particular <br /> regulation did not exist. The 40 ft. frontage setback is off of Shoestring Bay Road, and 50 ft. <br /> setback off the coastal bank. <br /> l <br />
