Catch basins are there but not faking water, <br /> so when it rains the water from the subdivision property <br /> runs through his property. like a river. He has constructed <br /> a galley to dry and stop further erasion of this property. <br /> Mr, Holmes was directed 'to investigate the problem and re- <br /> port to the Board. The Building Irispeetor will hold up <br /> building permits until those resp onsible for resolving the <br /> drainage problem have done s4. <br /> Marshall Stewart, passible buyer of the wail property on <br /> Rote 28, discussed the Board's determi.nation on the AN <br /> R <br /> applicati,on .for four lots on great Hay Road, The Board.: <br /> reiterated its criteria for defining a public way, which <br /> Great -Hay Road does not fit. Mr. Stewart referred to a <br /> land avurt plan which sowed Great Hay Road a "public road." <br /> The Board explained the wordy "public road" on the plan <br /> carries a different definition that "public way" 3n the <br /> zoning bylwlaw♦ <br /> Mr. Stewart questioned the Hoard"s conQern. in the serrri.o- <br /> ability of the road to his lots. Mr. Marsters explained <br /> the road would be used for tares vehicles such as bases, snow <br /> plows and possibly fire and police vehicles* Mr. Stewart <br /> asked the Board to offer a compromise of its position, ex- <br /> pressing his point .cf view, that the prospective owners of <br /> the lots would be aware of the roads condition. The Board <br /> would offer no compromise but suggested that the whole par- <br /> cel be submitted as one total subdivision plan, with Route <br /> 28 as the main access* and if homeowners withiM wished to <br /> use Great Hay Road, they would be free to do so, while town <br /> vehicles could use the Route 28 entrance. <br /> The meeting adjourned at 900, <br /> `: Deirdre Greelish <br />
