Minutes of the
Meeting of the
PLANNING BOARD
DATE. January , 1978
TIME: 8:oo
PRESENT s Thomas Bourgeois Earle Marsters
Richardson Jonas Harold Collins
Philip Holmes,Holmes,CE Donald Blakeman
Joseph Reardon, Town Counsel
Chapter 40, Sec . 6 has been rewritten as Chapter 693 , Acts of
1977, a s impl if'led version which allows the Town to choose a
wider range of options regarding road takings and repairs The
Selectmen have contacted homeowners associations requesting
volunteers to form a. committee to devise a by-law for the re-
pair and/or taking of private roads by the Town* This Board
will concentrate on the taking of roads in new subdivisions.
NEW ROADS IN SUBDIVISIONS
--wrwrrr_rrr..rrar_ i i i i.i rrrr.r_r...r_.iini..imur.ar_r_•vi•.vmvvvrnrnw-
The Board discussed bonding of the developer and bonding of
the builder as a direction whereby the condition of the
roads in developments could be/,protected. The developer
could pa. a filing fee of $100lot, or pair 10/lot and post
a bond for the other 0/lot. Mr o Bourgeois suggested an
alternative to the per lot fee would be a road footage for-
mula, so that a subdivision with large lots would be paying
a fee (or po sting a bond) in accordance with the real cost
of the roads. At the end of the bonding period--anywhere
from 3-5 years---the bond would be returned to the developer
if none of it was needed for road repairs during that time ,
If part of the money was needed, the balance would be re-
turned to the developer,
The Sandwich Zoning By-law offers a secondary protection in
that it bonds the house builder also , and rakes him re spun"
sible for that portion of the road on which the house fronts.
The bond is figured on a cost per running foot of frontage ,
and would be used by the Town if the road was damaged and
the builder didn't fix it. Also under consideration if the
8 ' pavement-driveway requirement in effect in Sandwich to
reduce the problem of washout from lots clogging storm drains ,
The developer would be asked to provide a. copy of the road
layout with bounds, "as-built , " to expedite the taking b
is the Town at some later date. The Board has not determined
s
