PLANNING BOARD MINUTES 12/19/7 9 cunt ' d Page 3 <br /> Mr. Marsters did go on to say the the above is not the answer, it just <br /> may be what happens ,, Clara Reliinui stated that there was no mis- <br /> representation, for certainly, Peters Enterprises , my brothers and myself <br /> would not misrepresent . The fact that the bank has foreclosed in the <br /> meantime was an unfortunate happening. <br /> Mr. Russell Peters asked Mr. Marsters if he considered himself in conflict- <br /> on interest to which Mr. Marsters replied no, because the subdivisions <br /> that he did have into Planning Board,' he removed himself from the Board. <br /> Dr. Cenedella. of New Seabury did not re-appear as requested tonight , <br /> Mr, Randy Peters came back in before the board tonight requesting a <br /> release of covenant on the piece of property off Cotuit Corners , formerly <br /> belonging to Leona White. Mr. Peters stated that according to his attorney <br /> when he acquired this particular piece of property, there was a right-of- <br /> way that he could use and would only have to put in about 200 of road in <br /> order to build. Planning Board advised Mr, Peters that he had no right <br /> to use roads belonging to another subdivis ion, 11r, Jonas asked who owned <br /> the road in question and was told Mr. Umina did., Planning Board will <br /> request Town Counsel go over the situation and advise, Mr Peters further <br /> added that all of the other lots are owned by different members of one <br /> family and he doubts they .will ever build on there. <br /> As per request of the Planning Board, the Mortgage Officer representing <br /> Bass River Savings Bank' appears again; along With Per LeBlanc, Richard <br /> Cohen and Robert Fox (latter two persons owning property in the area) <br /> regarding Tri,-Town. Circle area, Town Counsel had requested they come in <br /> regarding a difficulty on the roads . Due to the fact that Town Counsel <br /> was unable to appear tonight, all interested parties were asked to attend <br /> the next meeting on 1 6January 1980P. when Town Counsel would be here , <br /> Mr, Marsters d d ask that no conveyance of lots tape place until the advice <br /> of town Counsel was given, Mr, Marsters would like to see the original <br /> plan for Tri-Town and Horseshoe Bend, Mr, LeBlanc stated this would hold <br /> up present marketing for the bank and further points out that the road <br /> IS an ancient way; you will find that there are houses on both sides of. the <br /> road now. This road at one time serviced the cottages down by the water- <br /> front. When they deeded out the properties-, they deeded to the center <br /> of the road. There is no covenant concerning this whole property; and he <br /> does not want to go on record that he cannot convey, '11r t Terry and other <br /> members of the Planning Board agreed that was fair. All parties will <br /> attend next meeting <br /> Mr. John Umina representing QuasInnet valley Country Club subdivision comes <br /> before the Board with a- re duce d overall p 1 an. which was approved by the <br /> Board of Appeals and had been granted a Special Permit. Mr. Gerry Umina <br /> was also 'in attendance along with 'Mr. -Richard Baxter. Mr. Umina stated <br /> he was in the process of putting a Definitive Plan in. area B and had <br /> received a letter stating that the area had been re,zoned and he could no <br /> longer put lots in this section. Mr., Uminas understanding is that under <br /> his Special Permit that the detmination is to be made by the Board of <br /> Appeals and then at a later date he would have to co-Lie back to the <br /> Planning Board with a Definitive Plan, Mr. ,Jonas stated that guidlines <br /> must be adhered to and that the number of lots is determined by Planning <br /> y Pp <br /> Board, not b Board of Appeals .. Mr. Umina. wishes to know if there is a <br />
