Brings requesting a <br />Modification to an issued Written Finding (FINDING-2021-29) under § 174-24 (C) (9) (a) of the <br />Zoning Bylaws to allow for a sink and ductless A/C heat unit on the first floor. Applicant also <br />proposes to reconfigure deck removal, and proposes to remove the door between the garage and <br />dwelling on property located in the Popponesset Overlay District, and R-3 Zoning District, Map <br />at 23 Jeep Place, 118 Parcel 111, Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br />Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br />the Town of Mashpee, on October 21, 2022 and October 28, 2022 a copy of which is attached <br />hereto and made a part hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br />Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, November <br />9, 2022 at which time the following members of the Board of Appeals were present and acting <br />throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, <br />Scott Goldstein, Norman J. Gould, and Associate Member, George Ganzenmuller. <br />Attorney Christopher Kirrane represented the homeowners for the modification request. There are <br />no changes to the footprint. The original application conditioned no mechanicals allowed in the <br />garage. The storage above inside the garage is to remain unheated and unfinished. A portion of the <br />deck is being removed to remain within the 25% allowed lot coverage. A slop sink will be installed <br />and will have a floor drain to the septic, and a reconfiguration of the deck. The shed will be <br />removed. <br />The Conservation Department comments were read into the record, "No wetlands jurisdiction", <br />and Board of Health comments were read into the record; "Not a habitable space, no increase in <br />septic flow. Storage area cannot be used as a "bedroom". <br />
