HYNDS, <br />and I 1 INDUSTRIAL DRIVE, LLC, <br />Defendants. <br />REMAND ORDER <br />This is an appeal brought by John and Susan Fish (the "Plaintiffs") pursuant to M.G.L. c. <br />40A, § 17 from a decision of the Town of Mashpee Zoning Board of Appeals (the `Board") filed <br />with the Mashpee Town Clerk on May 20, 2020 (the "Decision"), as well as an action for declaratory <br />judgment pursuant to M.G.L. c. 231A and quiet title under M.G.L. c. 240. In its Decision, the Board <br />granted the Private Defendant, Steven P. Hynds, a special permit to construct a 9,680 square foot <br />steel building for use as office space and contractor bays at 89 Industrial Drive (the "Subject <br />Property") on land owned by Private Defendant, I 1 Industrial Drive, LLC. <br />
