MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A SPECIAL PERMIT <br />Owners, Linda H. Pierce and David A. Pierce <br />44 Waterway (Map 105 Parcel 208) <br />Mashpee, MA 02649 <br />SP-2022-46 <br />Attorney Kirrane mentioned that there are three infiltration areas to capture any roof runoff onsite. <br />The Attorney will not be opposed to any condition that the Board requires to keep all storm water <br />runoff onsite. The overall pervious material will be reduced by 120 sq. ft. from what currently <br />exists now. There will be no fill brought onto the property. The landscape plan was approved by <br />Conservation and shows a three quarter inch native pervious material for the cobblestone edging. <br />There will be a standard concreate pour with smart vents. <br />Attorney Kirrane mentioned that the basement will remain non -habitable space. The owners will <br />sign a non -conversion agreement as requested by the Building Commissioner. No floor drains are <br />allowed. The only use would be for building access, and for limited storage because it's a crawl <br />space. <br />Chairman Furbush asked about the parking situation, and the height of the dwelling. Mr. Luff said <br />that the ridge height is 34 ft. 1 inch. He will make sure that the construction documents that are <br />turned into the Building Department will have the allowed building height dimensions along with <br />the grading confirmed with the engineer. <br />The Board of Health and Conservation Department comments were read into the record. Board of <br />Health comments; Septic plan design has adequate flow. Plan shows 3 bedroom house. The project <br />was approved by the Conservation Commission. <br />SPECIAL PERMIT FINDINGS <br />• There is adequate land area to provide sufficient parking and setbacks as may be <br />required. <br />• The owners will sign a non -conversion agreement that the basement remain <br />unfinished as requested by the Building Commissioner. <br />• An engineer to confirm the allowed building height dimensions along with the <br />grading. <br />• All roof runoff will remain onsite. <br />GENERAL CRITERIA <br />The subject property located at 44 Waterway is approximately 15,599 square feet (upland). <br />An abutter had questions and were addressed by Attorney Kirrane. The parking is adequate and <br />will have and an attached two -car garage will be constructed. Attorney Kirrane said that the A/C <br />unit can be situated 5 ft. from the property line if it's under 120 sq. ft. The wall will be constructed <br />with a veneer stone. The front portion of the wall will be 8-10 inches, and the back of the wall will <br />be approximately 8 ft. A fence will be constructed on top of the wall which will screen the AC <br />unit. <br />2 <br />
