Pacheco and Leanne J. Fitzgerald <br /> request a Written Finding under§174-17 of the Zoning Bylaws to allow for an extension,alteration <br /> to a pre-existing nonconforming existing garage and dwelling on property located in an R-5 Zoning <br /> District, at 2 Sunset Circle Map 64 Parcel 1, Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee,on November 11,2022 and November 18,2022 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hail on Wednesday, December <br /> 14, 2022 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Acting Chairman, Ron Bonvie, Scott Goldstein, Norman J. Gould, Associate <br /> Members, Charles Reidy, and Robert Caggiano. Also present was David Morris, Building <br /> Commissioner. <br /> Attorney Christopher Kirrane represented the homeowners for their request for a Written Finding. <br /> Also present was Raul Lizardi-Rivera, with Cape & Islands Engineering, and Al Mendelson, <br /> General Contractor. This project is located in the Johns Pond neighborhood. The current structure <br /> is non-conforming at 29.8 ft. which fails to meet the 40 ft. front yard setback from Sunset Circle. <br /> The proposed alterations consist of a deck extension, an expansion of an existing garage from a <br /> one-car to a two-car garage,and a second story over the garage. There are no new non-conformities <br /> being created.Mr.Kirrane said the addition will be moved further back from the front yard setback. <br /> The deck will not be extending into the 50 ft. setback, and will not encroach on the rear setback. <br /> 1 <br />
