MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Steven Fagell and Phyllis Fagell <br /> 2 Cross Tree Way (Map 112 Parcel 19) <br /> Mashpee, MA 02649 <br /> SP-2022-56 <br /> The lot coverage is increasing to 19.9% but is still below the 20%. There are no new non- <br /> conformities being created, and there is sufficient parking as required. There will be a new <br /> innovative septic system installed, and the elevation of the new dwelling will be 34.7 ft. which is <br /> under the 35 ft. allowed height requirement. <br /> Attorney Kirrane concluded that the proposed redevelopment of this building is consistent with <br /> other redevelopment in the neighborhood, and is not substantially more detrimental than what <br /> currently exists. <br /> The Board of Health and Conservation Department comments were read into the record; "Health <br /> Department needs septic plans for 4 bedroom house." "The Conservation Commission approved <br /> this project at their December 81h meeting." <br /> Mr. Lizardi-Rivera said that the innovative system is an enhanced nitrogen reducing septic system, <br /> and requires a maintenance and inspection report to be submitted to the Board of Health. There <br /> has not been an agreement as of this date, but once the Board of Health has agreed to the septic <br /> plans it will be finalized. There are no requests for Variances, but does require a septic system <br /> permit. The permit will be submitted after the applicant has a conversation with the Board of <br /> Health. <br /> Mr. Bonvie said that historically an applicant will submit septic and site plans to the Board of <br /> Health for approval prior to submitting an application with the Zoning Board of Appeals. If the <br /> Board of Health does not agree to the proposed location on the plan, or the type of innovative, <br /> septic design, it will require another meeting with the Zoning Board of Appeals. <br /> Mr.Bonvie asked if the septic system design is an approved innovative system.Mr.Lizardi-Rivera <br /> said that it's an approved technology, and has permits with DEP. <br /> Attorney Kirrane said that the Board could condition upon submittal of the septic plans to the <br /> Board of Health. <br /> There were no more comments from the Board. <br /> GENERAL CRITERIA <br /> The subject property located at 2 Cross Tree Way is approximately 31,216 square feet. <br /> There were no abutters present. <br /> 2 <br />
