� Town of Mashpee <br /> ( �, ur 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> dµ <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2022-57 <br /> Owner, Joseph Anzivino Doc.: 1218614 <br /> 393 Monomoscoy Road Ctf.: 200056 <br /> (Map 124 Parcel 68) <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 2,2022 by Owner, Joseph Anzivino requesting a Special Permit <br /> under §174-17.1 of the Zoning Bylaws to raze and replace a pre-existing, nonconforming single- <br /> family dwelling on property located in an R-3 Zoning District, at 393 Monomoscoy Road, Map <br /> 124 Parcel 68 Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on November 11,2022 and November 18,2022 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, December <br /> 14, 2022 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Acting Chairman, Ron Bonvie, Scott Goldstein, Norman J. Gould, Associate <br /> Members, Charles Reidy and Brad Pittsley. <br /> Mr. Anzivino presented his raze and replace project request for a Special Permit. The house is <br /> currently pre-existing,non-conforming as it fails to meet the current lot size under the R-3 Zoning <br /> requirement. The new dwelling will meet the front, rear, and side setback criteria. Mr. Anzivino <br /> received Conservation Commission approval. The Board of Health Agent requested a revised plan <br /> to be submitted with some adjustments. <br /> The Conservation Department comments were read into the record; "this project was approved by <br /> the Commission at their November 10th meeting." Board of Health comments; "Septic plan <br /> received by Health Department has changes that need to be done. Design Engineer was notified <br /> on 11-7-22 but no response." The Health Agent submitted an email stating that the he is fine with <br /> the site plan, he just won't approve the septic until it's revised." <br /> 1 <br />
