Funk Pg.: 20 <br /> 5 Sheffield Place <br /> (Map 29 Parcel 29) <br /> Mashpee, MA 02649 <br /> A Petition was filed on October 14, 2022 by Owners, Christopher P. and Donna M. Funk <br /> requesting a Variance under §174-31 of the Zoning Bylaws to vary the side yard setback to allow <br /> for a 200 sq. ft. shed on property located in an R-5 Zoning District, at 5 Sheffield Place, Map 29 <br /> Parcel 150, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee, on November 11, 2022 and November 18, 2022. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the .provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, December <br /> 14, 2022 at which time the following members of the Board of Appeals were present; Acting <br /> Chairman,Ron Bonvie, Scott Goldstein,Norman J. Gould, Associate Member, Charlie Reidy and <br /> Robert Caggiano. Also present was David Morris, Building Commissioner. <br /> The Building Commissioner reviewed the shed request back in April for zoning compliance <br /> purposes and determined that the placement of the shed required a Variance. Ms. Funk presented <br /> a site plan dated December 15, 2021 that depicted a hand-drawn 10 ft. x 20 ft. shed showing a 15 <br /> ft. setback from the side lot line. The Board was handed another site plan dated September 30, <br /> 2022 that depicted the shed setback 11 ft. from the side lot line. The homeowner would like the <br /> shed located in front of a concrete apron of an existing pool. <br /> Mr. Bonvie reviewed the hand-drawn site plan dated Dec. 15, 2021 and noticed that the concrete <br /> patio of the pool depicts a distance of 30 ft. from the property line, and 15 ft. plus 10 ft. for the <br /> width of the shed which would be 25 ft. This would allow 5 ft. <br /> Ms. Funk said the shed approximately 13 ft. from the fence, but she thought it was 2 ft. closer to <br /> the fence. The fence existed since 2003. Ms. Funk thought the shed was rather large and doesn't <br /> believe that the shed would fit in between the concrete pad and fence. <br /> H HASHF .. TOWN i <br /> C . <br />
