Purpura Ctf.: 231246 <br /> 134 Shore Drive West <br /> (Map 132 Parcel 20) <br /> Mashpee,MA 02649 <br /> A Petition was filed on November 1, 2022 by Owners, Steven M. and Jill M. Purpura requesting <br /> a Variance under§174-33 (Setback from wetlands)of the Zoning Bylaws to allow for construction <br /> of a stairway to the beach on property located in an R-3 Zoning District, at 134 Shore Drive West, <br /> Map 132 Parcel 20, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee; on November 11, 2022 and November 18,2022 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, December <br /> 14, 2022 at which time the following members of the Board of Appeals were present; Acting <br /> Chairman,Ron Bonvie, Scott Goldstein,Norman J. Gould,Associate Members,Brad Pittsley, and <br /> George Ganzenmuller. <br /> Attorney,Christopher Kirrane presented the application for the Variance request.Also present was <br /> Raul Lizard-Rivera with Cape and Islands Engineering. The Variance request is for the 50 ft. <br /> wetlands setback under Section 174-33 for the purpose of constructing a set of access stairs from <br /> the top of the coastal bank down to the beach. The structure will be approximately 4 ft. wide by <br /> 46 ft. long. This project was approved by the Conservation Commission at their last meeting. <br /> An Order of Conditions has not been issued yet,but Drew McManus revised his comments stating <br /> that before any work can be done, mitigation has to be completed. <br /> Mr. Kirrane suggested that this Variance request is appropriate because the Board is aware that a <br /> hardship could exist due to topography, soil conditions, or lot shape.
