As this is a forced order from the <br /> Board. Mr. Harrington recommended the fine be $100 a day instead of the $200. <br /> There being to further comments or discussion, Kripani Patel motioned to issue a $100.00 fine to <br /> owners of properties that have not complied with the Board of Health order from September 9, <br /> 2021 to inspect and/or pump their property as it lies within 300' of Santuit Pond. Fines will begin <br /> to accrue on January 6, 2022 unless evidence of scheduling or pumping has been made. <br /> Motioned seconded by Ernest Virgilio. Roll call vote: Ernest Virgilio (yes); Kripani Patel (yes); <br /> Brian Baumgaertel (yes) VOTE: Unanimous (3-0) <br /> Mr. Harrington commented, in regard to sewers,the Sewer Commission stated that they were <br /> going to create a map that depicted the new phases and associated timelines for <br /> installation/availability. The new map will be instrumental in determining decisions concerning <br /> the next topics. One of the topics is the upgrade of cesspools in town. Is the board inclined to <br /> prohibit cesspools in any of the sewer phases? If so, Mr. Harrington recommended issuing that <br /> order for phases that have at least a 15 year timeframe for availability of the sewer system. That <br /> way,the system will get a near full life-cycle for a Title 5 system. <br /> One other topic the map will help with is the septic surveys. The Select Board has asked the <br /> Health Department to evaluate the situation of septic condition and maintenance for all <br /> properties within 300' of all water bodies. As the Santuit Pond survey is coming to a close, where <br /> is the next area that we should concentrate on? Phase 1 has not been done nor Phase 2. Phase <br /> 2 now has five separate sections. If we do surveys in those areas then the homeowners will pay <br /> for a pump and inspection ($700-$800)then in 5 years pay$2000-$5,000 for sewer connection. <br /> To be fair and consistent, all properties should be done. If you take into account the money, <br /> then the latter phases should be done (phases 3-5 or a portion of phase 2 depending upon the <br /> timeframes). <br /> NEW BUSNIESS <br /> 1. Review of approval of expense warrants. Expense warrants were signed by Ernest Virgilio, <br /> Kripani Patel and Brian Baumgaertel. <br /> 2. Review of request for Title 5 variance—17 Overlook Knoll Road. Mr. Harrington commented the <br /> property at 17 Overlook Knoll Road is currently serviced by a cesspool and is being sold. Per the <br /> Board of Health Cesspool Regulation,the cesspool is an automatic failure and is required to be <br /> upgraded prior to the sale of the property. Therefore, a variance has been requested to transfer <br /> the property without the system being upgraded. Paul Thurston, realtor for the buyer, introduces <br /> himself for the record. He explained the potential buyers are asking for a 10 month extension for <br /> a redesign of the home and septic system. A few months is needed for engineered plans to be <br /> made and then more time for the installation of septic system. Mr. Harrington asked Mr. <br /> Thurston if the house is getting teared down and rebuilt and if that was starting after the closing. <br /> Mr. Thurston answered yes and yes.
