Chair Baumgaertal commented there are better technologies out there to remove nitrogen, <br />however they are not approved so we cannot require someone to use an unapproved system. <br />So forcing them to get the older denitrification would not remove the nitrogen at the level we <br />would like to see. He would rather see technology that would help in the long run. The Board <br />of Health can not force him to use the better technologies but there could be an incentive for <br />the owner if they choose the better not approved technology which is better for the <br />environment. Chair Baumgaertal further discussed the potential liability the town could face if <br />they made a decision outside of DEP. Board members continued to discuss the liability the town <br />may face. They further discuss mediation and whether the owner would be open to it. Chair <br />Baurngaertal states that if cost is the factor, mediation is most likely not an option as there is a <br />cost involved. Mr. Harrington would like to get a definite on the new revised phase I map. The <br />current map takes 100 Great Neck out of Phase 1 and does not put it in any future phase. This <br />means that it will be a long time before sewer was availaWe if ever, so they would need a <br />denitrification system since the property is in, a nitrogen sensitive area. <br />Mr. Harrington will update town council on the discussion this evening and also contact the <br />tribal leaders to discuss a possible resolution, with the tribe, the town and the owners of the <br />There being no further comments or discussion Ernest Virgilio motioned to continue the <br />hearing for the appeal of DEP Title 5 Approval for 100 Great Neck Road North to the next <br />meeting.
