MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 8, 2023 <br /> Mr.Furbush reviewed and listed the Special Permit requirements under the bylaws 174-24 (C) (2). <br /> Mr. Furbush read the Plan Review Committee comments dated March 7, 2023 into the record. <br /> A motion was made by the Plan Review Committee recommending the following: <br /> • Board of Health requirements for a three (3) bay sink, and Title 5 Inspection. <br /> • Fire Department requirements; cut sheets, floor plans,review fire alarm panel <br /> and sprinkler system. <br /> • DPW Director Comments as detailed in an email dated March 7, 2023. <br /> Mr. Lehrer believes that his presentation to the Board regarding the parking situation of the site <br /> was adequate, and asked the Board if they would agree that any condition relative to comments <br /> from Plan Review do not include the DPW Director comments because he believes he satisfied <br /> the parking requirement. He doesn't want there to be a conflict between what is approved and what <br /> is added as a condition. <br /> Mr. Furbush said the Board can state the DPW comment on the record and state that the Board is <br /> satisfied with the explanation of the parking. The Board agreed. <br /> There were no final comments. <br /> Mr. Bonvie made a motion that the Board issue a Special Permit to Petitioner, CatDogg LLC at <br /> 800 Falmouth Road under §174-24 (K) and §174-25 (E) (16) of the Zoning Bylaws to allow for <br /> an adult-use cannabis retail facility and marijuana product manufacturing facility on property <br /> located in an I-1 Zoning District at 800 Falmouth Road, Units 102A and BIA, Map 88 Parcel 2, <br /> Mashpee, MA. (Owner of Record: Kevin P. Andrade, Trustee of Summerfield Park Realty Trust) <br /> with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. The site: 800 Falmouth Road, Units 102A is the retail, and B1A is the manufacturing <br /> located in an I-1 is an allowed use. <br /> 3. Conditioned on the recommendations submitted by the Plan Review Committee read into <br /> the record dated March 7, 2023. <br /> 4. Conditioned on the DPW Director Comments submitted on March 7, 2023. In referencing <br /> the DPW comments, the Board has found that the parking plan as submitted is sufficient <br /> and will meet the needs of the facility. <br /> 5. Conditioned on all other Town Department comments read into the record including but <br /> not limited to the Board of Health. <br /> 16 <br />
