Nocera Ctf.: 199228 <br /> 8 Helmsman Place <br /> (Map 105 Parcel 243) <br /> Mashpee, MA 02649 <br /> A Petition was filed on December 8, 2022 by Owners, John H. and Susan M. Nocera requesting a <br /> Written Finding under §174-17 of the Zoning Bylaws to allow for construction of a front deck <br /> addition to a pre-existing non-conforming single family dwelling on property located in an R-3 <br /> Zoning District, at 8 Helmsman Place, Map 105 Parcel 243, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on Friday, December 16, 2022 and Friday, December 23, 2022 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, January 11, <br /> 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, <br /> Ron Bonvie,Norman J. Gould, and Associate Member George Ganzenmuller. <br /> Mr. Peter Barsamian, General Contractor represented the homeowners for the deck project. He <br /> provided a site plan that depicts an odd shaped lot with the existing house that is pre-existing non- <br /> conforming. The proposed porch in the front is not encroaching any more than the existing corner <br /> of the house at 18 ft. The side yard lot line depicts an 18.2 ft. measurement from the existing deck. <br /> The Board determined that the distance of the proposed porch will be 23.3 ft., and therefore does <br /> not require variance relief from the front yard setback because the existing distance from the house <br /> is at 18 ft., and the proposed porch is not increasing the non-conformity. <br /> The Conservation Commission comments; "property is not within wetlands jurisdiction." The <br /> Board of Health comments;"to remain a 2 bedroom. No other comments for construction of front <br /> deck." <br /> 1 <br />
