Congro, Congro Remodeling <br /> requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for an alteration, of a <br /> front deck on property located in an R-3 Zoning District, at 121 Captains Row, Map 96 Parcel 48, <br /> Mashpee, MA. (Owners of Record: Charles E. and Eileen Sheehan.) <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on Friday, December 16, 2022 and Friday, December 23, 2022 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, January 11, <br /> 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board Members, <br /> Ron Bonvie,Norman J. Gould, and Associate Member, Sharon Sangeleer. <br /> Mr. Basil Congro, represented the homeowners seeking to replace their old deck with a new deck <br /> in the same location. The existing deck is built with a slight cantilever. <br /> The Board reviewed the site plan that depicts the setback of the side yard distance measuring 17.2 <br /> ft.from the deck,and the front setback measuring 24.4 ft.to the front yard lot line.The lot coverage <br /> will remain the same at 18.5%. <br /> Mr. Morris, Building Commissioner mentioned that he does not have an issue, but would like to <br /> have the engineering done because the house has overhangs over the deck. <br /> The Conservation Commission comments were read into the record; "property is not within <br /> wetlands jurisdiction."The Board of Health comments were read into the record;"has no problems <br /> with the extension of the front deck." <br />
