MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Arnold R. Henderson,Jr. and Jeannette A. Gerald <br /> 31 Quaker Run Road, Map 83 Parcel 8-0 <br /> Mashpee, MA 02649 <br /> SP-2023-14 <br /> Mr. Morris, Building Commissioner read a letter into the record dated February 13,2023 from the <br /> Engineer, Richard J. Hood, PLS. "I have been asked to write a letter stating that the proposed <br /> building at 31 Quaker Run Road will be built in the location shown on the plan. I have told the <br /> contractor that I will stake the proposed locations following the demolition of the existing house, <br /> (When requested to do so). I also recommended that the proposed foundation comers be pinned <br /> on the new footing. (When requested to do so.). I hope these assurances will serve. Best regards, <br /> Richard J. Hood, PLS." <br /> GENERAL CRITERIA <br /> The subject property located at 31 Quaker Run Road is approximately 7,382 square feet. <br /> There were no abutters present. <br /> Board of Health comments dated February 13, 2023 were read into the record: "Septic <br /> designed for two bedrooms approved on 6-22-22. Health Department is ok." <br /> Department of Public Works comments dated February 21, 2023 were read into the record <br /> from Catherine Laurent, DPW Director, "I spoke with a representative of the property <br /> owners at 31 Quaker Run. They are in agreement to construct a new driveway on their <br /> property and understand that a Curb Cut Permit would be required from DPW." <br /> The Board reviewed the site plan and building plans and determined there are no new non- <br /> conformities being created, and the existing shed will be removed. <br /> SPECIAL PERMIT CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses <br /> §174-17.1 Raze and Replace History: Added 10-15-2018 ATM,Article 16, approved by Attorney <br /> General 1-9-2019. <br /> No pre-existing, non-conforming single or two (2) family dwelling structures shall be tom down <br /> and rebuilt on any lot unless there is an issuance of a Special Permit from the Zoning Board of <br /> Appeals. Such a Special Permit may be granted only if the Zoning Board of Appeals finds that any <br /> changes, extensions, alterations or reconstruction of the pre-existing non-conformities are not <br /> substantially more detrimental than exists prior to removal of the existing structure and that there <br /> is adequate land area to provide sufficient parking. In no case shall new non-conformities be <br /> permitted without the issuance of a Variance. <br /> 2 <br />
