Town of Mashpee <br /> 16 Great Neck Road North <br /> ,. <br /> Mashpee, MA 02649 <br /> 0 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A MODIFICATION TO SPECIAL PERMIT (SP-97-73) <br /> MOD-2023-15 <br /> Owner, Mashpee 151 Properties, LLC Doc.: 1296499 <br /> 425 Nathan Ellis Highway Ctf.: 209808 <br /> (Map 72 Parcel 56) <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 3, 2023 by Owner, Mashpee 151 Properties, LLC requesting a <br /> Modification to an existing Special Permit(SP-97-73)under §174-24 (C) (9) and §174-17 of the <br /> Zoning Bylaws to allow for construction of a 1,800 sq. ft. addition to the rear of the existing retail <br /> building on property located at 425 Nathan Ellis Highway in an R3 and C2 Zoning District(s), <br /> Map 72 Parcel 56, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee,on February 17,2023 and February 24,2023 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, March 22, <br /> 2023, and was continued until April 12,2023 at which time the following members of the Board <br /> of Appeals were present; Chairman,Jonathan Furbush,Vice Chairman,William Blaisdell,Board <br /> Members, Ron Bonvie, Scott Goldstein, and Associate Member, Sharon Sangeleer. <br /> Attorney Christopher Kirrane represented the applicant's request for a Special Permit Modification <br /> for a 1,800 sq. ft. expansion of the convenience store known as Andy's Market. Also present was <br /> Mark Dibb, Engineer with Cape & Islands Engineering. The hearing was continued to afford the <br /> Board engineering peer review of a revised site plan and the drainage swale storm water <br /> management plan. The revised plans were submitted to Ed Pesce, Consulting Engineer who <br /> reviewed the plans and submitted his comments/recommendations on behalf of the Board. <br /> Chairman Furbush read Ed Pesce's letter dated April 12,2023 into the record.Mr.Pesce provided <br /> the Board his updated responses from Cape & Islands Engineering concerning the proposed <br /> addition as outlined in his letter as follows: <br /> i <br />
