Article 36 <br />To see of the Town will vote to amend Section 172-2 (Jurisdiction) of General Bylaw Chapter 172 (Wetlands) to <br />increase the current one hundred (100') foot buffer zone to wetlands to one hundred and fifty (150') feet, as <br />follows: <br />Ch. 172-2: Jurisdiction: <br />Except as permitted by the Conservation Commission or as provided in this bylaw, no person shall commence to <br />remove, fill, dredge, build upon, degrade, discharge into, or otherwise alter the following resource areas: any <br />freshwater or coastal wetlands; marshes; wet meadows; bogs; swamps; vernal pools; banks; lakes; ponds; streams; <br />creeks; beaches; dunes; estuaries; the ocean; lands under waterbodies; lands subject to flooding or inundation by <br />ground water or surface water; lands subject to tidal action, coastal storm flowage, or flooding; lands within one <br />hundred and fifty (150') feet of any of the aforesaid resource areas; rivers; and lands within two hundred (200') <br />feet of rivers (collectively the "resource areas protected by this bylaw"). Said resources shall be protected whether <br />or not they border surface waters. <br />Submitted by the Conservation Commission <br />Explanation: This article would increase the current one hundred (100') foot buffer zone to wetlands to one <br />hundred and fifty (150') feet in order to provide increased pollution and sediment removal from waters entering <br />wetlands, and to increase the area available for wildlife habitat. <br />The Select Board recommends approval of Article 36 by a vote of 4-1 <br />The Finance Committee recommends approval of Article 36 by a vote of 6-0 <br />Motion made by Select Board Member Wyman -Colombo <br />Motion: I move the Town vote to approve Article 36 as printed in the warrant. <br />Motion made to take a vote at 8:47 PM <br />Motion passes 333 to 113 at 8:52 PM <br />
