(This <br />needs to be passed by the Commonwealth legislature. Typically, 90 days). Mr. McManus <br />th <br />noted that the initial motion to close public hearing was 3/23/2023. The following April 6 ,2023 <br />hearing deliberation resulted in a denial to the applicant. Mr. McManus explained that the <br />applicant is arguing that the 21-day clock should have run from the earlier hearing and the denial <br />notice sent was, therefore, untimely. The applicant is arguing 21-day clock should be based on <br />public hearing closure and not the denial determination date. <br /> <br />Mr. McManus then went through the process of the superseding order works. \[All persons will <br />appear at the property etc.\] <br /> <br />th <br />Mr. McManus thought the 21-day was based on the April 6 date. <br /> <br />Mr. Colombo has been discussing this matter with Town counsel and Town manager. Mr. <br />Colombo noted that the date of issuance is the date of the post-mark. \[However, the homeowner <br />was at the meeting when the denial was issued\] If DEP issues a decision, Mr. Colombo noted <br />that there is caselaw to appeal. <br /> <br />In another matter, there is an Osprey nest on a cell tower. Mr. Colombo thought that the <br />engineers should not climb on the tower until after the eggs hatch and thought a letter may be <br />called for. <br /> <br />
