TOWN OF MASHPEE <br /> BOARD OF APPEAIS <br /> DECISION <br /> Rei Petition of Ockway Bay Development Corporation (73 Gia lane) for a Variance <br /> A Petition was filed by Ockway Bay Development Corporation for a <br /> Variance under Section 7.4 of the Land Space Requirements for permission to <br /> vary the minimum lot frontage, minimum lot size, and minimum side yard depth <br /> requirements, to resubdivide the land in order to correct lot lines, on property <br /> located at 73 Gia Iane, Uckway Bay, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975• <br /> Notice was given by publication by publishing in the Falmouth Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee on April 22, 1980 and <br /> May 2, 1960, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, May 7, 1980 at 8:30 p.m. at which time the following members of <br /> the Board of Appeals were present and acting throughout: Michael Makunas <br /> Raymond G. Sweeney, Peter Muse. <br /> Mr. John Slavinsky, representing the Petitioner explained to the <br /> Board that the development was constructed without any regard to existing lot <br /> lines, and in order to draft a new plan to submit to the Planning Board, a <br /> variance would be required. <br /> The Board established that granting the request for Variance, as <br /> presented, would not be in harmony with the general purpose and intent of the <br /> ordance or By-law, and would be detrimental to the Town. <br /> Upon motion duly made and seconded, the Board voted unanimously <br /> to deny the request for variance as requested. <br />
