TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Re: Petition of Edward Toland for a Special Permit <br /> A petition was filed by Edward Toland, of Falmouth, Massachusetts <br /> for a Special Permit under Section 6.3, F-5, of the Land Use Regulations <br /> for permission -to operate a plant shop on property located at the New <br /> Seabury Shopping Mall, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975• <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on May 6, 1980, <br /> and May 16, 1980, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, May 21, 1980 at 8100 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: Raymond <br /> G. Sweeney, Peter L. langler, Peter Muse. <br /> Mr. Toland indicated to the Board the existance of the structure <br /> and the operation of the plant shop. The Petitioner attended numerous <br /> meetings of the Board to request guidance as to a direction to comply wtih <br /> the conformity of the axa to remain in operation of the business. <br /> Upon motion duly made and seconded the Board voted unanimously <br /> to grant the request for a Special Permit, but to impose the restriction of <br /> the Permit to expire on October 1, 1980. <br /> MASHPEE BOARD OF APPEALS <br /> BY: <br /> �J <br />
