TOWN OF MASHPEE <br /> BOARD OF APPEAIS <br /> DECISION <br /> Rei Petition of William P. Bellis for a Variance <br /> A petition was filed by William P. Bellis of Popponesset, <br /> Massachusetts, for a Variance under Section 7.4 of the land Space Requirements <br /> for permission to vary the minimum side yard depth requirements on property <br /> located on Alma Road, Popponesset Beach, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on June 3, 1980, <br /> and June 10, 1980, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, June 18, 1980 at 8330 p.m, at which time the following members <br /> of the Board of Appeals were present and acting throughout3 Robert J. Houle, <br /> Raymond G. Sweeney, Peter L. Jangler. <br /> A representative for the Petitioner explained that the Petitioner <br /> had a shed constructed on the property, and later was informed of the <br /> requirement of a variance, as it was situated too close to the abutting <br /> property. <br /> Despite the fact that there was a violation of the pertinent <br /> zoning by-law in this Town, and a deomonstration of an intentional violation <br /> of the building code, which is duly noted in this decision, the Board <br /> unanimously voted to treat the Variance application as one for a Special <br /> Permit, and granted a Special Permit to the applicant. <br /> It is the considered opinion of the Board that the applicant <br />
