TOWN OF MAS HPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Re: Petition of Jean P. Canning for a Variance <br /> A petition was filed by Jean P. Canning for a Variance under <br /> Section 4.1 of the Application of Regulations and Section 14.1 of the <br /> Enforcement and Penalties, for permission to erect multi-family structures, <br /> and an extension of use of property located on Route 28, south of rotary <br /> s <br /> (map 81, parcel 3), Mashpee, Massachusetts. <br /> t Notice was duly given to abutters in accordance with Massachusetts <br /> General laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975• <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on June 10, 1980, <br /> and June 17, 1980, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, June 25, 1980 at 8130 p.m. , at which time the following members <br /> of the Board of Appeals were present and acting throughouti Robert J. Houle, <br /> Peter L. Iangler, Peter Muse. <br /> A representative for the Petitioner presented a plan to the Board <br /> showing the proposed condominiums, consisting of one hundred and twenty (120) <br /> units. <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> deny the request for Variance as requested. <br /> The Board found that a literal enforcement of the provisions of <br /> the ordanance or by-law would not involve substantial hardship, financial <br /> or otherwise, to the petitioner, and that a granting of the Variance. <br /> i <br />
