L_ 1 TOWN OF MASHM BOARD OF APPEALS DECISION Res Petition of Jean P. Canning for a Special Permit { A Petition was filed by Jean P. Canning of Falmouth, Massachusetts for a Special Permit under Section 6.3 of the Special Provisions, for permission to erect garden apartments, and attached dwellings on property located on Route 28 (Map 81, Parcel 3), Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. Notice was given by publication by publishing in the Falmouth Enterprise, a newspaper of general circulation in the Town of Mashpee on January 8, 1980, and January 18, 1980, a copy of which is attached hereto,and made a part hereof. A public hearing was held on the petition at the Mashpes Town Hall on Wednedday, January 23, 1980 at 8x45 p.m. at which time the following members of the Board of Appeals were present and acting throughout& Michael Makunas, Chairman, Peter L. langler, Robert J. Houle. Mr. Michael Dunning, representing the Petitioner, explained to the Board that the original plan had been endorsed by the Planning Board in February, 1973. After submitting memoranda for the Board's consideration, Mr. Dunning indicated the intension of the Petitioner to construct a multi- family development. On February 6, 1980, the hearing continued, at which time a preliminary plan of the proposed project was submitted, along with additional memoranda, and a copy of the origianl plan of 1973. Upon motion duly made and seconded the Board voted unanimously to deny the request for a Special Permit as requested.
