MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 12, 2023 <br /> The Board had a conversation and would like to add a condition based upon positive comments <br /> from the Town Planner,and if his comments are not positive than the application will be required <br /> to return to the Board. <br /> Mr. Furbush asked for comments from the audience. <br /> Ms. Lynn Barbie, Surf Drive. She learned about this proposal through the Human Services <br /> Committee, and agrees it's a good use of this space but she does not want this application to set <br /> a precedence to other buildings within Mashpee Commons. She also commented that Mashpee <br /> Commons will starting building the other residences they said they are going to build. <br /> Tom Feronti responded and thanked Ms. Barbie for the positive comments. He said that if this <br /> Board ultimately decides to approve this project, and receives positive comments from the Town <br /> Planner, he hopes that this application will set a precedence so that Mashpee Commons can <br /> repurpose other building space that is underutilized to incorporate residential housing into those <br /> other spaces. <br /> Mr. Reidy wanted to make sure that the Board is in favor of the repurposing of this building, and <br /> based on receiving positive comments from the Town Planner. <br /> Mr. Furbush asked for a motion to close public comments. Ms. Sangeleer made a motion to close <br /> the public comments. Mr. Ganzenmuller seconded. All were in favor. <br /> Mr. Reidy made a motion that the Board issue Petitioner, Mashpee Commons Limited Partnership <br /> a Modification to an existing Special Permit (SP-86-04-024)to allow for re-purposing the second <br /> floor of an existing mixed-use building on property located in the C-1 Zoning District, Map 74 <br /> Parcel 20, Mashpee, MA with the following conditions. <br /> 1. The Board has determined that the applicant meets the conditions, and with discussion <br /> the members of the Board voting are unanimously in favor of this proposed use of the <br /> building. <br /> 2. Proposed Floor Plan: Building 31, at 46 Market Street, Mashpee, MA. Prepared by: Imai <br /> Keller Moor Architects, Project No: 22221, Drawn by: PC, CM, MS, Issue Date: July 11, <br /> 2023, Proposed 1st. Floor Plan, Proposed 2nd Floor Plan. <br /> 3. Mashpee Commons,Parking Demand Sheet(Special Permit Area) dated 7/7/23. <br /> 4. Conditioned on all Town Department comments read into the record. <br /> 5. The Board finds that the re-purposing of the second floor of an existing mixed used <br /> building is an allowed use under the existing Special Permit (SP-86-04-024). <br /> 9 <br />
