Town o,f Mashpee <br /> uu 16 Great Neck Road North <br /> ' Mashpee, MA 02649 <br /> t <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 26,2023 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, July 26, 2023, at <br /> 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road North. <br /> Chairman, Ronald Bonvie, Board Members, Jonathan Furbush, Scott Goldstein, Sharon <br /> Sangeleer, and Associate Member, Charles Reidy. <br /> Chairman Bonvie opened the meeting at 6:00 pm and announced that the hearings were being <br /> televised live on Mashpee TV. He will take comments after each hearing. <br /> CONTINUED HEARINGS <br /> 90 Po .wonesset Island Road: : Owner, Brendon P. Giblin requests a Special Permit under§174- <br /> 17.1 and §174-33 of the Zoning Bylaws to raze and replace a pre-existing, non-conforming <br /> structure and replace it with a new single-family residential structure with associated pool, <br /> detached garage with guest suite above on property located in an R-3 Zoning District, Map 106 <br /> Parcel 34, Mashpee,MA. (Continued from May 24, 2023 hearings at the request of the Board to <br /> make a determination on July 26, 2023 to either extend the hearing or accept a withdrawal if <br /> there is nothing in writing submitted to the Conservation Department from DEP.) <br /> Attorney Christopher Kirrane represented the applicant. Attorney Kirrane reviewed the <br /> Conservation Department comments that were submitted. This project was appealed to DEP, and <br /> is now under review with the Massachusetts Environmental Policy Act (MEPA who requires that <br /> the State Agencies study the environmental consequences of their actions, including permitting <br /> and financial assistance.) Attorney Kirrane understood that Mark Dibb with Cape & Islands will <br /> be doing a site visit in August, and the MEPA review might be completed the end of August, and <br /> Mr. Dibb believes that it will be at least 30 days before DEP issues any decision. Attorney Kirrane <br /> can accept a continuance until the October hearings, or he can withdraw the application without <br /> prejudice, and refile. <br /> Chairman Bonvie would like to withdraw. Attorney Kirrane asked for a motion to withdraw <br /> without prejudice. Ms. Sangeleer made a motion to close the public comments. Mr. Furbush <br /> seconded.All were in favor to close the public comment. Mr.Reidy made a motion that the Board <br /> accept the withdrawal without prejudice from Attorney Kirrane relative to 90 Popponesset Island <br /> Road for the request of a Special Permit under Section 174-17.1 and 174-33 to raze and replace a <br /> single family structure. Mr. Furbush seconded. All were in favor. <br /> 1 <br />
