Expense Warrants – There were no expense warrants presented. <br /> <br />2. Review and Approval of Minutes. 6/6/2023. <br />The minutes were unanimously approved with Mr. Raposa making the motion to accept the <br />minutes as provided with Mr. Livingston seconding. <br /> <br />Roll Call Vote: Ed Raposa (Yes), John Livingston (Yes), Ernest Virgilio (Yes) <br />3 – 0 Unanimous. <br /> <br />3. Review of Request of Variance Pool Testing, Bayview Condominium, Deborah Davis <br />\[Bayview Condominium Trust has requested a variance, in writing, from 105 CMR 435.000: <br />Minimum Standards for Swimming Pools, for their outdoor pool and spa. Specifically, they are <br />seeking relief from the testing requirements set forth in Subsection 29, Paragraph (2), which <br />states: Tests for residual disinfectant shall be made four times daily, once during the peak load <br />by the pool operator, or more often if required by the Board of Health. Under Subsection 46 of <br />the regulation, the Board of Health may vary the application of any provisions of 105 CMR 435.00 <br />when, in its opinion, (a) the enforcement thereof would do manifest injustice; and (b) the <br />applicant has proved that the same degree of protection required under 105 CMR 435.00 can be <br />achieved without strict application of the particular provision.\] <br /> <br />
