Article 9, a citizen’s
petition, was presented for discussion. Mr. Weedon noted that the FINCOM indicated
support for Article 9 (5-1 vote) and the Selectboard supports the Article as well (3-1-1 vote).
Mr. Weedon noted title to the Old Indian Cemetery has already been transferred to the Tribe
in 2008. Article 9 seeks to authorize the Selectboard to consider transferring land for purpose
of expanding the Old Indian Cemetery. Mr. Weedon noted that Town bylaws state that the
Conservation Commission has first rights to land disposed of by the Town. Ms. Clapprood
asked about the history of the proposed plan – done as a Citizen’s petition as before with
other proposals such as the Town Seal. Mr. Weedon went on to note the IGA will still be
honored – the initial land transfers were done through the IGA and preclude the parties from
seeking legal redress for land issues. The current cemetery is near or at capacity, and there
are approximately 4,000 Tribal members who would be eligible to be buried (and that does
not include spouses or other community members). Mr. Kent noted that the Agents have no
concerns about the transfers. Mr. Weedon noted the parcels would be transferred at FMV
($200,000). Wrapping up, Mr. Colombo noted that Mr. Weedon was not seeking a
Conservation Commission vote and that Article 9 would be presented at the Town meeting
requiring two-thirds vote, negotiations would be entered into with the Town (with
