6:15 11 Taffrail Way. Gregory R. and Hillery Lee. Request for minor change to previously AA

approved sea wall on OOC 43-3133. Representative: Cape & Islands Engineering, Inc.
(continued from 8/24)

The purpose of the Administrative Approval is to raise the bulkhead about 1.5 feet as
recommended by the contractor. The footprint and mitigation do not change.

Mr. Colombo noted that all the Commissioners had an opportunity to do a site visit. Mr.
Colombo asked about the Cedar tree at the corner of the deck noted on the plan whether it
was staying. Regarding the Oak leaning over – it will be staying, but limbed up. The fill will
not cover the tree only for the portion going down the bank. Mr. Colombo asked how the fill
will be put in – by Bobcat to bring behind the bulkhead going back and forth. There will be
handwork as well. Mr. Cook noted the barge would bring in the fill. Mr. Colombo asked
about 4” tree with the will stay – the fill will diminish moving landward and will not impact the
tree. Ms. Godfrey asked about how the the tree removal will be accomplished – typical
handsaw and would not drop into the water. The sawdust going in the water is not an issue
since there are no chemicals. Mr. McManus concurred noting the material is organic – no
effect on the fish. Mr. Cook asked when the construction would commence – during winter
with less potential impact on fish.

\[Ms. Clapprood left the meeting at this point\]

Mr. Cook made a motion for approval of the administrative request, which was seconded by
Ms. Copeland.

Roll Call Vote:

Steven Cook (Yes)
Erin Copeland (Yes)
Sandra Godfrey (Yes)
Paul Colombo (Yes)

4 – 0 (unanimous)

6:18 42 Wheeler Road, Marcio DeJesus. Proposed raze and replace of single-family dwelling NOI
43-3252
with associated landscaping and hardscaping. Representative: Cauley Site Services, LLC
(continued from 9/7)

The applicant went through the proposed project: moving the single-family dwelling upland
with no substantial increase in footprint and noted the bocce court (not permitted) needs to
be addressed and will do so. Mr. Cook echoed the concern about the bocce court within the
buffer zone, sand on the beach – like that historically – whether the pond’s edge was proper
delineation of the buffer zone. Mr. McManus clarified that the beach area known as
“bordering land subject to flooding” is the resource area but noted that the delineation of the
average flooding area was lacking. Mr. Cook noted the pond elevation was high – the
groundwater level: whether there is a foundation planned? The applicant has not received
the final plans. Following up, Mr. Cook asked about a monitoring well and erosion control in
the plan. Mr. Colombo asked about a Maple (72” tree) given the excavation planned. The
proposed house is coming landward away from the Maple. The tank would fall under BOH
and the applicant is waiting for the meeting. Mr. Cook noted the mitigation is only the east
side only – the applicant will confront and spread over the property. Regarding the bocce
court, Mr. McManus asked for a new plan to address revegetating the bocce court area
